Self Employed: Your Obligations

What are your obligations?

Below are some of your obligations under the Working with Children legislation. It is important to know your obligations as non compliance can result in a fine of up to $60,000 and five years imprisonment. For a detailed list see of Factsheet 13: Information for Self Employed People.

If you are Self Employed:

  • You must not carry out child-related work unless you have a current WWC Card or have applied for one within the required time.
  • Keep adequate records to demonstrate your compliance with the legislation.
  • You must give written notice to the Working with Children Screening Unit as soon as practicable if you have a relevant change in criminal record.
  • You must not carry out child-related work if you have been convicted of a Class 1 offence committed as an adult.
  • You must not carry out child-related work if you are issued with an Interim or Negative Notice.

Penalties of up to $60,000 and 5 years imprisonment apply in relation to offences under the WWC legislation.
